If a vehicle does not conform to the manufacturer’s written new vehicle warranty and the consumer reports the nonconformity to the manufacturer within one year after purchase or during the first 18,000 miles, whichever is earlier, the manufacturer must make any repairs necessary to conform the vehicle to the warranty.

If the manufacturer is unable to conform the vehicle to the manufacturer’s warranty after a reasonable number of repair attempts,  the manufacturer must replace or repurchase the vehicle.  Case law provides the following to prove reasonable repair attempts:

  1. Substantially the same nonconformity has been subject to repair three or more times and either continues to exist or recurs;
  2. The vehicle is out of service by reason of repair for a cumulative total of thirty or more calendar days;
  3. There have been eight or more attempts to repair any nonconformity; or
  4. There has been at least one attempt to repair a nonconformity that results in a condition that is likely to cause death or serious bodily injury if the vehicle is drive, and the nonconformity either continues to exist or recurs.
